Recent win in Court of Appeals
December 17th, 2010Vance Barron saves case for injured motorist. Vance was hired by an accident victim whose lawyer filed his personal injury case three years and one day after the wreck. The defendants moved to have the case dismissed because the statute of limitations says suit must be filed within three years and that the suit was a day late. Vance investigated and learned the defendant was in the military and the statute of limitations did not apply. The trial court agreed but the defendants appealed. DePuy Hip Recall
October 8th, 2010Since 2003 thousands of defective hip replacement systems have been sold by DePuy Orthopaedics, a subsidiary of Johnson & Johnson. At the prompting of the FDA, Johnson & Johnson has recently recalled DePuy’s ASR XL Acetabular and ASR Hip Resurfacing systems. Common problems are that the hip components do not fit together correctly resulting in serious complications that may include pain, loosening of the implants, fractures of the hip and pelvis and dangerous metal particles being shed into surrounding tissue and the blood stream. If you have received such an implant you may have been notified and instructed to contact your doctor for an evaluation and blood work to see if you have metal in your system. BARRON AND BERRY SETTLES CLASS ACTION
July 28th, 2010On June 28, 2010 final court approval was given to a class action filed over five years ago. The lawsuit was on behalf of people who took out advances from Legal Bucks, LLC, a “litigation funding company,” that charged interest of over 100% per year to people with personal injury claims. As a result of the lawsuit and the decision of the North Carolina Court of Appeals the practice of lending money at these rates against personal injury lawsuits is illegal. Suit against Toyota for Uncontrolled Sudden Acceleration
July 22nd, 2010On December 11, 2009, a Greensboro man was severely injured when his 2004 Lexus LS430 suddenly accelerated out of control as he was exiting a parking garage. The car could not be stopped with the brakes and collided with a building and a power transformer. Barron & Berry has filed suit against Toyota Motor Corporation, the manufacturer, to recover compensation for his injuries caused by the automotive defect that precipitated the collision. The sudden uncontrolled acceleration of automobiles has led to numerous other suits across the nation and is a matter of grave concern to motorists.
